Please do not use our website or services if you disagree with any part of these Terms and Conditions.
The following Terms and Conditions have been prepared to help you make the most of The Space 2 Be. Please take a few moments to read them thoroughly.
Interpretation and Variation
1.1 In the Terms and Conditions the following definitions apply:
“Member” means any person that has completed and submitted the health questionnaire at The Space 2 Be and whose registration has been accepted by The Space 2 Be
“Studio” means The Space 2 Be, Broxbourne Business Centre, Suites 1,2,&3, Fairways, Cheshunt, Herts. EN8 0NJ
“Terms and Conditions” means these terms and conditions.
“Website” means www.thespace2be.co.uk
1.2 References in the Terms and Conditions to the singular will include the plural and vice versa and references to the masculine gender will include references to the feminine gender .
1.3 The Terms and Conditions are incorporated into and form part of the health questionnaire.
1.4 The Space 2 Be reserves the right to vary and revoke the Terms and Conditions from time to time which variation it may consider necessary or desirable for the regulation of the affairs of the Studio and the conduct of Members. Any such changes will be notified to Members and, until revoked, are and will be binding for Members.
1.5 The Terms and Conditions will be governed by the laws of England and subject to the exclusive jurisdiction of the English courts.
2.1 Subject to condition 2.2, when a person has completed the health questionnaire they become a Member of the Studio.
2.2 Acceptance of a person as a Member is at the absolute discretion of The Space 2 Be.
2.3 The Space 2 Be reserves the right to expel from the Studio, suspend for a specific period or refuse to renew the membership of, any Member whose conduct is or may, in The Space 2 Be ‘s reasonable opinion, be injurious to the character of the Studio, or which amounts to a breach of the Terms and Conditions, or where such expulsion is otherwise in the interests of the other Members of the Studio. Any Members so expelled will forthwith cease to be Members of the Studio and will not be entitled to any refund for any period during which the membership is suspended.
Booking and Cancellation
3.1 A Member may only book, reschedule or cancel sessions via their personal Studio booking facility on the website or by telephoning the Studio.
3.2 Members can cancel to reschedule sessions up to 4 times a year but must give the Studio or booking system 24 hours notice. Failure to cancel a session within 24 hours of its start time will result in the Member being charged for the session and foregoing their right to reschedule. Rescheduled sessions will be taken in addition to the regular classes attended and must be taken within 6 weeks of the original scheduled date.
3.3 Sessions are booked on a first-come first-served basis. A Member may use the waiting list facility on the Website in the event that his first choice session is unavailable. If a Member joins the waiting list for a particular session and then books that session his booking will be subject to the Terms and Conditions in the usual way.
3.4 Out of consideration for the instructor and other members, and also for your own safety (the warm-up is an important aspect of each class) please arrive at least 5 minutes early in preparation for the class. Please be aware that other classes may be taking place so please wait in the designated area quietly. Please be aware that if you are more than 5 minutes late for a class you will not be able to take part. In this instance The Space 2 Be reserves the right to charge you for the session. If you arrive late within the first 5 minutes please be considerate to other members and enter the class quietly.
Studio Opening Times
4.1 Details of session times at The Space 2 Be may vary from time to time, including cancellations of individual classes. Class times will be published by the Studio and will be available either at the Studio or on the Website
4.2 Class size is limited, therefore entry is on a first come, first served basis. All attendance must be pre-booked and paid for where applicable.
4.3 The studio will be closed 2 weeks over the Xmas period. Prices have been calculated to take this into consideration ie you have been charged for 50 weeks of the year so you will still be required to pay the full price in December.
5.1 Details of class prices are available directly from the Studio and will be such prices as determined by The Space 2 Be from time to time.
5.2 Before attending a session at The Space 2 Be each Member must pay for the session in full, book themselves into a session and, prior to their first session at the Studio, complete the health questionnaire (this is available on line and in the studio). Each Member should arrive at the Studio 15 minutes before their first session to complete the health questionnaire to enable the teacher time to review the information.
5.3 Subject to any statutory right of cancellation, payments for classes, monthly subscription fees and annual payments are non-refundable and nontransferable unless otherwise stated in the Terms and Conditions.
5.4 The ‘Free taster class’, is available to book via the Website or in the Studio, and shall only be available to clients for their first session in the Studio. This is available for yoga and pilates separately so each member is entitled to 3 ‘Free taster classes’.
5.5 If you are receiving a loyalty discount if you default on your payment or cancel your payment you lose the privilege of this discount and will be charged the standard rate for all future payments (subject to 6.2).
Direct Debits and recurring payments by debit card
6.1 The provisions of this clause 6 shall only apply to Members that subscribe for The Space 2 Be classes by monthly direct debit or recurring debit card payment (“Subscription”)
6.2 Any Member, who is purchasing classes by Subscription, will forfeit their membership if they fall behind in payment for more than 10 days.
6.3 A Member, who is purchasing classes by Subscription, may at the discretion of The Space 2 Be, suspend their membership for a period of up to three months (but not less than one month) in any 12 month period. However, your place on a class cannot be reserved or guaranteed when you return.
6.4 Subscription fees must be paid in accordance with the Terms and Conditions irrespective of whether or not the Member uses the Studio‘s facilities.
6.5 Members shall be given not less than 10 working days written notice of any increase in their Subscription.
6.6 Members purchasing classes by Subscription will be allocated access to the number of classes per month based on the monthly package they choose and subscribe to as detailed on the website.
6.7 Monthly rolling contracts will automatically roll over at end of each month. It is the responsibility of the client to advise The Space 2 Be in writing should they wish to terminate their contract, 1 month in advance.
Any Member that is purchasing classes by Subscription can cancel their Subscription by giving the Studio 1 months written notice of the desired cancellation date. To give notice of cancellation of a Subscription a Member must complete a cancellation form, which is available from the Studio. The notice period will begin when the completed cancellation form has been received by The Space 2 Be.
6.8 Where you pay by subscription you are entitled to book your classes 3 months in advance. It is your responsibility to ensure your class is booked in advance to guarantee your place. If availability is showing this means that another member may book that place.
Refunds and cancellation of classes policy
6.9 Cancellations of bookings are accepted up to 24 hours in advance and substitute sessions may be booked (subject to availability) up to 4 times per contract year providing the substitute session is booked within 6 weeks of the scheduled cancelled class. No refunds are offered for classes that cannot be attended.
6.10 Cancellations within 24 hours are forfeited. If you are unable to attend a session due to circumstances beyond your control, The Space to be will determine on a case by case basis if an alternative class may be attended. This will be considered upto a maximum of 2 times a year for Maintain package and 4 times a year for Improve and Transform packages.
6.11 Cancellations must be made through the online booking system.
6.12 If a class needs to be cancelled by The Space 2 Be due to severe external conditions beyond its control eg. Unsafe road conditions, travel conditions, adverse weather, no refunds are payable. An alternative class booking will be offered.
6.13 Monthly prices are based on 50 classes per year to allow a 2 week closure at Xmas

7.1 If at the end of the first month you are not completely satisfied, providing you have attended all sessions and followed all recommendations, you will be entitled to a full refund.
7.2 No requests for refund will be considered until the end of the first month, nor where sessions have been missed.
7.3 Requests for refunds must be made in writing to The Space 2 Be within 7 days of completion of the first month of classes giving the reason for not being entirely satisfied. We reserve the right to discuss this with you to ensure we obtain feedback to help us improve our services.
Fitness and Health
8.1 Members are advised not to undertake strenuous physical activities without first seeking medical advice if they have concerns over their physical condition. The Space 2 Be reserves the right to refuse access to any Member if, in its absolute discretion, it considers that the health of the individual concerned may be endangered by the use of its facilities.
8.2 Members are required to follow the instructions of the instructor at all times.
8.3 Members are required to inform a member of staff, if they incur injuries or conditions, or become pregnant after the initial information stated on their health questionnaire.
Use of Facilities
9.1 A Member is entitled to use the Studio’s facilities, during normal operating hours as detailed on the timetable, provided always that the Studio may at any time without notice withdraw all or part of its facilities for any period or periods and with notice, where practicable, in connection with any cleaning, repair, alteration or maintenance work, or for reasons beyond the control of The Space 2 Be.
9.2 Children between the ages of 14-16 may only use the Studio and attend classes if accompanied by an adult (and only where all relevant forms supplied are completed). 16-18 year olds can attend classes unaccompanied but authority forms will be required to be completed by a relevant adult.
Safety and Hygiene
10.1 In the interests of safety and hygiene, no crockery or glass are permitted in the Studio. Only water is permitted to be taken into the studio in a sealed bottle. No pets (with the exception of guide dogs), are permitted in the Studio. Before Members enter the class they are required to remove their shoes and leave them in the designated area outside the studio. However, Members must not walk around the Studio barefoot if they have verrucas or similar foot complaints. Please wear socks or indoor flip-flops.
10.2 Members must use the main entrance to the Studio when entering or leaving the Studio. Fire exits, which are clearly marked, are there in the interests of safety and Members must not interfere with these exits for any reason.
10.3 In the event of a fire, Members are asked to make their way to the nearest available fire exit.
10.4 Smoking is forbidden in the Studio.
11.1 Personal belongings are brought onto the Studio premises at the Member’s own risk and The Space 2 Be does not accept liability for any loss or damage whatsoever to such items. Personal belongings are not to be left in the studio there is a designated area off of the studio which is secure where Members are to leave their personal belongings.
11.2 All mobile phones should be switched to silence once you have entered the Studio.
11.2 Parking is available at the rear of the building after 6pm and at weekends. At all other times you will need to find alternative arrangements. At no time are you authorized to park at the front of the building through the white gates which is signposted Broxbourne Property Services and designated parking for Broxbourne council staff only. Breach of these terms and conditions will not be tolerated. If you park here you also run the risk of having your car removed or locked in as the gates are locked at varying times each day and the Studio does not have access to the key.
11.3 Vehicles parked to the rear of the Studio are parked at the Member’s own risk and the Studio accepts no liability for any loss or damage whatsoever to such vehicle.
Limitation of Liability
12.1 The Space 2 Be cannot be held responsible for any particular session, instructor and/or item of pilates equipment not being available for whatever reason. The Space 2 Be reserves the right to make alterations to the sessions, instructors and/or equipment, as well as to the ancillary facilities provided to Members, without notice and in its absolute discretion and The Space 2 Be will not be liable for any loss occasioned by such alterations except insofar as such loss is by law incapable of exclusion.
12.2 It is the Member’s responsibility to ensure that he is capable of undergoing a routine of exercises provided by any programme which he follows or session which he attends. Members accept the risk of injury from performing exercises and using specialist equipment and are advised to consult their doctor prior to beginning any session. Advice provided by instructors at The Space 2 Be at no time constitutes medical advice in substitute for advice provided by a medical professional
12.3 The Space 2 Be accepts no liability for loss or damage to property of Members or for injury to Members on the Studio premises or outside the Studio except insofar as such loss, damage or injury is by law incapable of exclusion.
12.4 In consideration of their participation in the activities and programmes of The Space 2 Be and the use of facilities and equipment owned and/or under the control of The Space 2 Be the Member hereby waives and releases The Space 2 Be and it’s instructors from any and all responsibility or liability for injuries or damages resulting from their participation in any of the The Space 2 Be activities or use of The Space 2 Be equipment or facilities save in respect of death or personal injury caused by the negligent act or omission of The Space 2 Be
13.1 Members are required to give notice to The Space 2 Be of any change of home address, email address and telephone number. Failing such notice, all communications will be assumed to have been received by the Member within five days of mailing to the last address (of either type) notified to The Space 2 Be
13.2 The Space 2 Be reserves the right to refuse admission to the Studio.
13.3 The Space 2 Be may, if a Member so wishes, communicate with the Member by electronic mail (“email”). By providing an email address to The Space 2 Be, the Member consents to receiving email communications from The Space 2 Be, including notices pursuant to the Terms and Conditions. The Member also accepts the risk that email may not be a secure and confidential means of communication. The Space 2 Be will not be liable for any loss or damage suffered as a result of communicating with a Member by email.
13.4 Any marketing, educational or other materials of this nature whatsoever produced by The Space 2 Be in connection with the Studio and which are made available to Members at the Studio, will at all times remain the property of The Space 2 Be and will be subject to the The Space 2 Be copyright.
